Seller Agreement
At check-in, all consignors must sign the Seller Agreement to participate in the resale.
To complete your registration, please review and agree to the following terms:
- Consignor agrees to hold harmless and make no claim against Lise Esper, 2nd Chance Childrens Resale, lesser or owner of the space where the sale is held, any volunteer or paid participants in the 2nd Chance Childrens Resale, or the insurer of the 2nd Chance Childrens Resale for the damage, theft, or loss of any items consigned to 2nd Chance Childrens Resale. 2nd Chance Childrens Resale does not anticipate any thefts, damage, or loss and takes every precaution to prevent them, but occasionally these events may occur.
- Consignor agrees to waive any and all claims for personal injury resulting from participation in the 2nd Chance Childrens Resale from whatever cause either foreseen or unforeseen against Lise Esper, leaser or owner of the space where the sale is held, any volunteer or paid participants in the 2nd Chance Childrens Resale, or the insurer of the 2nd Chance Childrens Resale.
- All goods left in the possession of 2nd Chance Childrens Resale are at the sole risk of the Consignor. Consignor agrees that it shall assume and bear all risks regarding consigned goods, and will hold 2nd Chance Childrens Resale exempt from any and all liability. Should items be lost, stolen or damaged, 2nd Chance Childrens Resale is not responsible to compensate the Consignor for the items.
- Consignor agrees that no claims will be made against 2nd Chance Childrens Resale for any discrepancies involving items placed in the sale.
- Items left after pick-up become property of 2nd Chance Resale.
- All merchandise without tags that do not get claimed automatically become property of 2nd Chance Resale (i.e. Lost & Found).
- Consignor has reviewed recalled items on the CPSC website: www.cpsc.gov/cpsclist.aspx and testifies that to their knowledge, none of the items being submitted to the 2nd Chance Childrens Resale has been recalled, meets with the CPSC standards for children’s products, or in the case of a car seat, has not been in an accident.
- Consignor agrees to cash checks issued as proceeds from the sale within 90 days. Seller proceed checks will be mailed within 2 to 3 weeks after the close of the sale. Any checks not cashed after 90 days will be voided. A new check, minus the return check fee of $35.00, can be requested after this time.
- Consignor agrees that the distribution of proceeds from the sale of each item will be as follows:
- Your commission will be 65% of the proceeds. The Principal will retain 35%.
- All consignors or replacements are required to volunteer a minimum of 4 hours. Failure to work your scheduled hours will result in only a 50/50 split and an additional $35.00 deduction.
